Terms of Service.
Scope
These terms govern your use of the tremont.ai website and of any Tremont AI product, demo, evaluation or beta you access without a separate written agreement. If your organization has a written agreement with Tremont AI, Inc., that agreement governs your use of the products and these terms apply only to the website.
By using the website or a product you agree to these terms. If you are using them on behalf of an organization, you confirm you have authority to bind it.
Eligibility and accounts
You must be at least 18 years old. If we give you an account, keep your credentials confidential and tell us promptly if you believe they have been compromised. An organization that administers accounts for its users is responsible for their use.
Access and acceptable use
We grant you a limited, non-exclusive, non-transferable right to access the website and any product made available to you, for your internal evaluation or business purposes. You agree not to:
- Copy, modify, reverse engineer or attempt to extract the models, weights or source code
- Resell, sublicense or offer the products to third parties
- Use the products to build a competing product or to benchmark them for publication without our written consent
- Interfere with the security or operation of the products
- Upload content you do not have the right to upload
Evaluation, demo and beta use
Demos, evaluations and beta features are provided for assessment only, may change or end at any time and are not meant for production use. We may limit their scope and duration.
Study data and sensitive data
You are responsible for having the rights and consents needed to upload any study data to a product. Do not upload protected health information or other data subject to specific legal regimes unless our written agreement with your organization provides for it.
Your content
You own the data and content you provide. You grant us the rights needed to host, process and display it in order to provide the products to you and to keep them secure. We do not use your study data to train our models unless you have agreed to it in writing.
AI outputs
Our products use machine learning models. Their outputs, including predicted findings, descriptions and summaries, may be incomplete or wrong. Outputs are provided to support the work of qualified professionals. A toxicologic pathologist or other qualified person must review them before they are relied on. You are responsible for how you use outputs.
Research and preclinical use only
Our products are intended for research and preclinical use. They are not medical devices and are not intended for the diagnosis, treatment or prevention of disease in humans or animals, or for any clinical decision. Regulatory submissions remain your responsibility and must follow the requirements of the relevant authority.
Intellectual property
Tremont AI and its licensors own the products, the models, the website and all related intellectual property. Some of our technology is licensed from Mass General Brigham. If you send us feedback, we may use it without restriction or obligation.
Confidentiality
Each party will keep the other's non-public information confidential and use it only as needed under these terms. This does not apply to information that is public, already known or independently developed.
Fees
Products provided for a fee are governed by the order form or agreement that sets the fee. Unless it says otherwise, fees are non-refundable.
Termination
Either party may end your access at any time. We may suspend access that we reasonably believe violates these terms or threatens the security of the products. Sections that by their nature should survive, including intellectual property, confidentiality, disclaimers and limitation of liability, survive termination.
Disclaimers
The website and products are provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
Limitation of liability
To the fullest extent the law allows, Tremont AI will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from the website or products. Our total liability under these terms will not exceed the greater of the fees you paid us in the twelve months before the claim and one hundred US dollars.
Indemnity
You will defend and indemnify Tremont AI against claims arising from content you upload or your breach of these terms.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Boston, Massachusetts, and you consent to their jurisdiction.
Changes and notices
We may update these terms. We will post the new version here and update the date at the top. Continued use after a change means you accept it. We may send notices by email, through the products or by posting on the website.
General
These terms are the entire agreement between you and Tremont AI about the website and any product not covered by a separate agreement. You may not assign them without our consent. If any part is found unenforceable, the rest remains in effect.
